Avalon does hereby certify that to the best of its knowledge, dog sold is in good health, free of genetic defects, and that all vaccinations are current. All known faults have been declared to buyer. Please be aware that Avalon takes great care in selecting its breeding stock. Only quality dogs from well-established bloodlines are used in our breeding program. Buyer shall be given a period of 72 hours to have dog examined by a licensed veterinarian. In the unlikely event that a health problem with dog is discovered and written diagnosis is supplied to Avalon, dog may be returned to Avalon for exchange or refund of the purchase price listed above at our discretion. Avalon is not responsible for any veterinary fees incurred by Buyer, and all returns are at Buyer's expense.

At Avalon we breed only from quality stock and conscientiously try to eliminate faults from our bloodline. Because our breeding stock is sound, healthy, and from the best bloodlines available, we are able to minimize the instance of faults and health defects. However, toy dogs by nature can be subject to a number of faults at maturity which may not obvious when the puppy is a young age. Buyer understands that purchasing a toy dog involves risk. Additionally, because a dog’s ability to be shown to AKC Champion status is largely dependent on his/her training, socialization, grooming, nutrition etc., we are not able to offer a guarantee of any kind that a puppy will finish to AKC Champion status.

Satisfaction guarantee: If your puppy does not meet with your satisfaction, he/she may be returned in good condition within 2 weeks for exchange or refund of the purchase price at our discretion. If veterinary care is required to rehabilitate a returned puppy for any reason, the associated costs will be subtracted from any refund amount. Shipping and health certificate costs to return puppy and receive any replacement puppy are the Buyer’s responsibility. Health guarantee: If written veterinary documentation of a genetic health defect is provided by six months of age, we will exchange your puppy or offer a refund at our discretion. Avalon is not responsible for any veterinary fees incurred by Buyer. Show Prospect Guarantee: If you purchased a puppy described above as "show prospect," and a major fault is present at maturity, we will refund to pet quality price provided that detailed veterinary documentation describing the fault along with veterinary proof of neuter/spay is provided by one year of age. Major faults that CAN occur in all toy dogs, and that qualify for refund from show prospect to pet quality price include: 1) Undershot or overshot bite as long as any retained baby teeth have been properly removed. 2) Retained testicle(s) in males. 3) Mature weight under 3 pounds or over 7 pounds as long as dog is neither overweight nor anorexic. 4) Patellar luxation above grade 2. Please be aware that obesity and injury can cause patellar luxation. No luxation claims will be considered on obese or injured dogs. Again we breed only from sound, healthy, carefully screened breeding stock and rarely experience these problems. We just want to ensure that you understand that they can occur in all toy breeds. Although not a fault, we want to point out that toy dogs sometimes retain baby teeth, and these must be removed so that they do not adversely affect your dog’s bite. Current pet quality puppy price: $1,000.00.

At Avalon, we care very much about the future of the Pomeranian breed. As responsible breeders, we feel that pet dogs should not be bred. If you have purchased a pet quality puppy,  he/she is being sold with a spay/neuter contract. Buyer agrees to have dog spayed/neutered by one year of age. The “Limited Registration” box on your dog’s AKC papers will be checked to remove the incentive for you to breed. (Should you breed your dog contrary to your agreement, puppies born of said dog will not be eligible for AKC registration.)

We ship by Delta/Skywest (and other Delta partners), FOB Pocatello, ID.  Freight must be prepaid or COD and will not be refunded should dog be returned. An airline approved shipping crate & accessories are required. Unless you prefer to send your own, Avalon will purchase the crate & accessories for you for our cost of $40.00 (includes #100 kennel, food/water dishes, crate pad, tube of Nutri-Stat or Nutri-Cal & toy).  A veterinary health certificate is necessary for shipping and will cost an additional $40.00 if your puppy is under 3 months or age, or $50.00 if your puppy is over 3 months (includes required rabies vaccination).  International Health Certificates are subject to additional charges. Puppies are normally shipped by 12 weeks of age. If you require us to hold your puppy for you past 12 weeks of age, a $100.00 per month ($25.00 per week) boarding/grooming fee will apply.  In the event that Buyer returns dog to Avalon  for or any reason he/she will do so at his/her own expense.

Entire Agreement.  This agreement is the complete agreement between Seller and Buyer and no promises or guarantees are made unless contained herein in writing.  Any changes or additions to this agreement must be in writing and signed by Seller and Buyer.

Waiver of Warranties.  BUYER WAIVES ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  The only warranties given are those expressly set out herein.

Facsimile Copies.  This agreement may be signed by both parties or is also complete if each party signs a copy of this agreement and sends a facsimile copy to the other party.

Jurisdiction, Venue and Attorney’s Fees.  The sole jurisdiction and venue for any suit filed by Seller or Buyer in any way connected with this agreement shall be in Bannock County, Idaho.  The prevailing party in any litigation shall be entitled to their reasonable costs and attorney’s fees.

Buyer does hereby agree to provide a loving home for dog, treat him/her humanely, and to practice responsible canine ownership. Buyer certifies that he/she has read Avalon's puppy care sheet and is aware of the care needs for Pomeranian dogs:  http://www.avalonpom.com/PupCareSheet.html. Under no circumstances will dog or puppies born of dog be sold to a pet store, puppy mill, or animal broker.
